Divorce Case Legal Service Fee

Divorce is a legal process through which a marriage is formally dissolved by a competent court. The overall cost of a divorce case in India depends on the type of divorce, complexity of the matter, duration of proceedings, court level, and the Advocate representing the parties.

Types of Divorce Cases

Mutual Consent Divorce

  • A Mutual Consent Divorce is filed when both spouses agree to end the marriage and mutually settle issues relating to alimony, child custody, maintenance, and property matters.
  • Estimated Professional Fee: Rs. 15,000 – Rs. 60,000

Contested Divorce

  • A Contested Divorce is filed when one spouse disputes the divorce or there are disagreements regarding maintenance, child custody, property division, domestic violence allegations, or other legal issues.
  • Estimated Professional Fee: Rs. 50,000 – Rs. 3,00,000+

Court-Level Fee Structure

Family Court / District Court

  • Mutual Consent Divorce: Rs. 15,000 – Rs. 60,000
  • Contested Divorce: Rs.  50,000 – Rs. 3,00,000+
  • Per Hearing Charges (if applicable): Rs. 2,000 – Rs. 15,000 per hearing

High Court

  • For appeals, revisions, transfer petitions, or other matrimonial proceedings before the High Court.
  • Estimated Professional Fee: Rs. 1,00,000 – Rs. 5,00,000+

Supreme Court of India

  • For Special Leave Petitions (SLP), appeals, transfer petitions, and other matrimonial matters before the Supreme Court.
  • Estimated Professional Fee: Rs. 50,000 per hearing and above (Senior Advocate fees may be substantially higher depending on the matter).
