Permanent Patent (Complete Specification) Services
A Permanent Patent, officially known as a Patent with Complete Specification, is the final and full legal protection granted to an invention by the Indian Patent Office. Once granted, it gives the patent owner exclusive legal rights to make, use, manufacture, sell, license, assign, and protect the invention from unauthorized commercial use by others.
Unlike a Provisional Patent Application, which only secures an early filing date, a Complete Specification contains the full technical disclosure of the invention along with legal claims that define the exact scope of protection. Filing a Complete Specification is mandatory either directly or within 12 months after filing a Provisional Patent Application.
Under Section 9 of the Patents Act, when a provisional specification is filed, the complete specification must be filed within 12 months from the filing date of the provisional application; otherwise, the application is treated as abandoned. This is also confirmed in official Patent Office guidance.
A granted patent in India generally remains valid for 20 years from the filing date of the patent application, irrespective of whether it started with a provisional or complete specification, subject to payment of renewal fees.
A Complete Specification generally includes:
- Title of the Invention
- Field of the Invention
- Background and Prior Art
- Problem Solved by the Invention
- Detailed Description of the Invention
- Best Method of Working the Invention
- Claims (Legal Scope of Protection)
- Abstract
- Technical Drawings and Flow Diagrams (if applicable)
- Inventor and Applicant Details
The claims are the most important part because they define the legal boundary of patent protection. A patent specification is considered a “techno-legal” document because it provides both technical disclosure and legal protection boundaries.
Permanent Patent registration is commonly used for:
- New Products
